Member Rights - Caring Connections for Special Needs, LLC

The following is a more detailed list of your member rights (click on English or Español below):

  • CCSN ensures that at the time of referral, a member’s parent/legal guardian receives a written list of the member’s rights in a language the member or their legal representative understands.
  • The Member Rights Statement is explained to the member in their primary language. A member who does not speak English, or who has a physical or other disability, is assisted to understand their rights.
  • A member has the right to be treated with dignity, respect, and consideration.
  • A member has the right not to be discriminated against based on race, national origin, religion, gender, sexual orientation, religion, age, disability, marital status, diagnosis, or source of payment.
  • A member has the right to receive treatment that supports & respects the member’s individuality, choices, strengths, and abilities.
  • Member is not subjected to exploitation, coercion, manipulation, sexual abuse, sexual assault, restraint or seclusion (except as allowed in R9-10-1012(B) or misappropriation of personal and private property by agency staff, volunteer or student.
  • The member has the right to receive treatment that support’s the member’s personal liberty and only restricts those personal liberties according to court order or by member consent.
  • The member has the right to receive treatment and services in the least restrictive environment necessary to comply with treatment goals.
  • A member will not be prevented or impeded from exercising their civil rights unless the member is adjudicated incompetent or a court or competent jurisdiction has determined the member is unable to exercise a specific right or category of rights.
  • The member or legal guardian has the right to submit grievances to agency staff members and complaints to outside entities and other individuals without constraint or retaliation.
  • The member has the right to have their grievance reviewed by a qualified authority in a fair, timely, and impartial manner.
  • The member has the right to seek, speak to, and be assisted by legal counsel of the member’s choice, at the member’s expense during the grievance process.
  • The member has the right to receive assistance from a family member, designated representative, or other individual in understanding, protecting, or exercising their rights.
  • The member or individual enrolled as seriously mentally ill has the right to receive assistance from human rights advocates provided by the network or the network’s designee in understanding, protecting, or understanding their member rights.
  • The member has the right to confidentiality of their record. Information will be released as permitted by state statues or by signed member/legal guardian consent to release information.
  • The member’s guardian has the right to consent to photography, if used in the agency for identification purposes.
  • The member has the right to privacy in treatment, including the right not to be fingerprinted, photographed, recorded, or videotaped without prior and signed consent.
  • The member/legal guardian has the right upon written request to review his or her own record during agency business hours at a time agreed upon (according to A.R.S 12-12293,12-2294, and 12-2294.01).
  • The member has the right to be informed of all fees that the member is required to pay and of the agency’s refund policies and procedures before receiving behavioral health services except when service is provided to the member experiencing a crisis situation.
  • The member/legal guardian has the right to voluntarily consent to treatment, unless treatment is ordered by a court of competent jurisdiction, after receiving a verbal explanation of the member’s condition and the proposed treatment, including the intended outcome, the nature of the proposed treatment, any procedures involved in the proposed treatment, any risks of noncompliance with treatment recommendations or side effects from the proposed treatment, and any alternative to the proposed treatment.
  • The member/legal guardian has the right to be referred for treatment specified in the member’s treatment plan to another agency if the agency is unable to provide a behavioral health service that the member requests or that is indicated in the member’s treatment plan.
  • The member has the right to refuse treatment or withdraw consent to treatment unless such treatment is ordered by a court or is necessary to save the member’s life or physical health.
  • The member has the right to receive services free from abuse, neglect, retaliation for submitting a complaint, discharge or transfer, or threat of discharge or transfer, for reasons unrelated to the member’s treatment needs, except as established in a fee agreement signed by the member/parent/guardian, denial of food, sleep, and use of the toilet facilities.
  • The member or parent/guardian has the right to participate in decisions and in the development and periodic review and revision of the written treatment plan. 
  • The member/legal guardian has the right to control his or her own finances.
  • The member has the right to refuse to participate in religious activities.
  • The member has the right to refuse to perform labor for an agency. If the member works for the agency, the work shall be in the member’s interest. If the primary purpose of this work is to benefit the mental health treatment agency, the member shall be paid in accordance with the law. If the purpose of the work is therapeutic, the member may or may not be paid as circumstances indicate. This therapeutic work shall be part of a planned program of treatment described in the member’s record with the rationale for the work-treatment included. It shall be periodically reviewed by the appropriate agency review procedures.
  • The member has the right to refuse to participate in research or experimental treatment. 
  • The member has the right to refuse to acknowledge gratitude to the agency through written statements, or other media, or speaking engagements at public gatherings.
  • The member has the right to receive treatment in a smoke free environment.
  • CCSN asegura que en el momento de su referencia/presentación, el padre/tutor legal del miembro recibirá una lista escrita de los derechos del miembro en el idioma que el representante del miembro o representante legal entiende.
  • La Declaración de “Derechos de los miembros” se les explicó a los miembros en su idioma principal. Un miembro que no habla inglés, o que tiene una discapacidad física o de otro tipo, se le asistirá para entender sus derechos.
  • El miembro tiene el derecho a ser tratado con dignidad, respeto y consideración.
  • El miembro tiene el derecho a no ser discriminado por motivos de raza, origen nacional, religión, sexo, orientación sexual, edad, discapacidad, estado civil, el diagnóstico o forma de pago.
  • El miembro tiene el derecho a recibir tratamiento que apoya la individualidad aspectos del miembro, opciones, fortalezas y habilidades.
  • El miembro no está sujeto a explotación, coerción, manipulación, abuso sexual, asalto sexual. restricción o reclusión (excepto en lo permitido en R9-10-1012(B) o apropiación indebida de propiedad personal y privada por el personal de la agencia, voluntario o estudiante.
  • El miembro tiene el derecho a recibir el tratamiento que apoye la libertad personal del miembro y sólo restringe las libertades personales de acuerdo con la orden judicial o por el consentimiento del miembro.
  • El miembro tiene el derecho a recibir tratamiento y los servicios en el ambiente menos restrictivo necesario para cumplir con los objetivos del tratamiento.
  • No se le Impedirá al Miembro de ejercer sus derechos civiles a menos que el miembro se ha adjudicado incompetente o un tribunal o jurisdicción competente ha determinado que el miembro es incapaz de ejercer un derecho específico o categoría de derechos
  • El miembro o tutor legal tiene derecho a presentar quejas al personal de la agencia y quejas a entidades externas y otros individuos sin restricciones o represalias.
  • El miembro tiene el derecho de que sus quejas sean revisados por un empleado de autoridad calificado, de una manera justa, oportuna e imparcial.
  • El miembro tiene el derecho a buscar, hablar con, y ser asistido por un defensor de la elección del miembro, que será pagado por el miembro durante el proceso de queja.
  • El miembro tiene el derecho a recibir la asistencia de un miembro de la familia, representante designado, u otro individuo para comprender, proteger o ejercer sus derechos.
  • El miembro o individuo inscrito como seriamente enfermos mentales tiene derecho a recibir asistencia de defensores de los derechos humanos proporcionados por la red o la persona designada por la red para comprender, proteger o entender los derechos de sus miembros. 
  • El miembro tiene el derecho a la confidencialidad de su expediente. La información se dará según lo permitido por las estatuas estatales o por consentimiento firmado por el miembro/tutor de divulgar la información.
  • El tutor del miembro tiene el derecho a dar su consentimiento a fotografías en la agencia, con el propósito de identificación.
  • El miembro tiene el derecho a la privacidad en el tratamiento, incluyendo el derecho a no tomar las huellas digitales, fotografía, grabado, o filmado con una videocámara sin el consentimiento obtenido y firmado.
  • El miembro/tutor legal tiene el derecho a solicitar/pedir por escrito para revisar su propio expediente en horario de oficina de la agencia, en un tiempo acordado. (de acuerdo con A.R.S 12-12293. 12-2294, y 12- 2294.01).
  • El miembro tiene el derecho a ser informado de todas las cuotas que el miembro está obligado a pagar y de las políticas y los procedimientos de reembolso de la agencia antes de recibir servicios de salud mental, excepto cuando el servicio se proporciona al miembro de experimentar una situación de crisis.
  • El miembro/tutor legal tiene el derecho de consentir voluntariamente a tratamiento, a menos que el tratamiento es ordenado por un tribunal de jurisdicción competente, después de recibir una explicación verbal de la condición del miembro y el tratamiento propuesto, incluyendo el resultado deseado, el motivo de la propuesta del tratamiento, todos los procedimientos implicados en el tratamiento propuesto, cualquier riesgo de incumplimiento de las recomendaciones de tratamiento o efectos secundarios del tratamiento propuesto, y cualquier alternativa al tratamiento propuesto.
  • El miembro/tutor legal tiene el derecho a ser referido para tratamiento especificado en el plan de tratamiento del miembro a otra agencia, si la agencia no puede proporcionar el servicio de salud mental que el miembro Exija/pida o esta mencionado en el plan de tratamiento del Miembro.
  • El miembro tiene el derecho a rechazar el tratamiento o retirar el consentimiento al tratamiento al menos que dicho trato es ordenado por un tribunal o es necesario para salvar la vida del miembro o la salud física.
  • El miembro tiene el derecho a recibir servicios libre de: abuso, abandono, represalia por la presentación de una queja, despedido o transferido, o amenazado a riesgo de ser despedido o transferencia, por razones ajenas a las necesidades de tratamiento del miembro, con excepción de lo establecido en un acuerdo de pago firmado por el miembro/padre/tutor, la negación de alimentación, el sueño, y el uso de las instalaciones sanitarias.
  • El miembro o el padre/tutor tiene el derecho a participar en las decisiones y en el desarrollo y la revisión periódica y la revisión del plan de tratamiento.
  • El miembro/tutor legal miembro tiene el derecho de controlar sus propias finanzas.
  • El miembro tiene el derecho de negarse a participar en las actividades religiosas.
  • El miembro tiene el derecho de negarse a realizar un trabajo para la agencia. Si el miembro trabaja para la agencia, la obra será de interés para el miembro. Si el propósito principal de este trabajo es en beneficio de la agencia de tratamiento de salud mental, el miembro deberá pagarse de conformidad con la ley. Si el objetivo de la obra es terapéutico, el miembro puede o no puede ser pagado como las circunstancias lo indican. Este trabajo terapéutico será parte de un programa planificado de tratamiento descrito en el expediente del miembro con la justificación de la Obras para el tratamiento incluido. Será revisado periódicamente por los procedimientos de la agencia apropiada.
  • El miembro tiene el derecho de negarse a participar en la investigación o el tratamiento experimental.
  • El miembro tiene el derecho de negarse a reconocer agradecimiento a la agencia a través de declaraciones escritas, u otros medios, o hablar en reuniones públicas.
  • El miembro tiene el derecho a recibir tratamiento en un ambiente libre de humo de cigarrillo.
